Terms and Conditions Livepuro

These terms and conditions apply to every offer made by Livepuro and to every distance contract concluded between Livepuro and the customer.
Article 1 – Identity of the trader

Article 2 – Definitions
- Reflection period: the period within which the consumer can make use of the right of withdrawal.
- Consumer: the natural person not acting for purposes related to their trade, business, craft, or profession.
- Distance contract: a contract concluded between Livepuro and the consumer through an organized system for distance selling (webshop), without the simultaneous physical presence of both parties.
- Right of withdrawal: the consumer's option to withdraw from the distance contract within the reflection period.
- Trader/Livepuro: the natural or legal person offering products to consumers at a distance.
Article 3 – Applicability
- These terms and conditions apply to every offer made by Livepuro and to every distance contract concluded between Livepuro and the customer.
- Before the distance contract is concluded, the text of these terms and conditions is made available to the customer. Where this is not reasonably possible, it will be indicated that the terms can be reviewed at Livepuro and will be sent free of charge upon request.
- Deviation from these terms is only possible if expressly agreed in writing.
Article 4 – The offer
- All offers made by Livepuro are without obligation. Livepuro is entitled to change and adjust the offer.
- The offer contains a complete and accurate description of the products offered, detailed enough for a proper assessment by the customer.
- Obvious mistakes or errors in the offer (for example, clearly incorrect prices) do not bind Livepuro.
- All images, photos, and data on the website are indicative. Deviations in color, size, or similar do not give grounds for compensation or dissolution of the contract.
Article 5 – The contract
- The contract is concluded at the moment the customer accepts the offer and meets the corresponding conditions.
- Livepuro will confirm receipt of the acceptance of the offer electronically without delay (order confirmation by email).
- Livepuro takes appropriate technical and organizational measures to secure the electronic transfer of data and ensures a safe web environment.
Article 6 – Right of withdrawal (returns)
- When purchasing products, the consumer has the option to dissolve the contract without giving reasons for a period of 14 days. This reflection period starts on the day after the consumer receives the product.
- During this period, the consumer will handle the product and its packaging with care. The product may only be unpacked or used to the extent necessary to assess the nature and characteristics of the product.
- If the consumer wishes to exercise the right of withdrawal, they must notify Livepuro within the reflection period by emailing info.livepuro@gmail.com.
- The risk and burden of proof for correct and timely exercise of the right of withdrawal lie with the consumer.
- The consumer bears the direct costs of returning the product, unless stated otherwise on the website or unless Livepuro has failed to state that the consumer must bear these costs.
- In case of withdrawal, Livepuro will refund all payments made by the consumer, including any delivery costs, without delay and within 14 days of being informed of the withdrawal, provided the product has been received back in good condition (or proof of return has been provided).
- Excluded from the right of withdrawal may be: sealed products that are not suitable for return for reasons of health protection or hygiene if their seal has been broken after delivery (relevant, for example, to certain care or household products).
Article 7 – Prices
- All prices displayed on the website are in euros (or the local display currency), inclusive of VAT.
- Shipping costs are included in the listed product price, unless stated otherwise. No separate shipping fee is charged at checkout.
- Livepuro is entitled to change prices. However, orders already placed will be fulfilled at the price applicable at the time of ordering.
Article 8 – Payment
- Payment is made through the payment methods offered on the website, including: credit card (Visa, Mastercard, UnionPay), Apple Pay, Google Pay, and Shop Pay.
- The customer must promptly report any inaccuracies in payment details provided or stated to Livepuro.
- Payment is made prior to shipment of the product.
Article 9 – Delivery and execution
- Livepuro ships to the following countries: the Netherlands, Belgium, Spain, Italy, the United States, the United Kingdom, Romania, Belarus, and Hungary.
- The place of delivery is the address the consumer has made known to Livepuro.
- Livepuro will process accepted orders with due care and speed, within [number] days at the latest, unless a different delivery period has been agreed. The consumer will be informed in case of any delay in delivery.
- The risk of damage and/or loss of products rests with Livepuro until the moment of delivery to the consumer, unless expressly agreed otherwise.
- For deliveries outside the European Union (including the United States, the United Kingdom, and Belarus), import duties, customs fees, or local taxes may apply. These costs are the responsibility of the customer, unless stated otherwise, and fall outside Livepuro's control.
Article 10 – Conformity and warranty
- Livepuro guarantees that the products comply with the contract, the specifications stated in the offer, reasonable requirements of soundness and/or usability, and the legal provisions in force on the date the contract was concluded.
- No additional (manufacturer's) warranty is offered beyond the statutory warranty; the statutory conformity rules apply in full.
- Any defects must be reported to info.livepuro@gmail.com within a reasonable time after discovery.
Article 11 – Complaints procedure
- Complaints about the execution of the contract must be submitted to Livepuro fully and clearly described via info.livepuro@gmail.com, within a reasonable time.
- Complaints submitted to Livepuro will be answered within a period of 14 days from the date of receipt. If a complaint requires a longer processing time, Livepuro will respond within this period with an indication of when a more detailed answer can be expected.
Article 12 – Liability
- To the extent permitted by law, Livepuro's liability is limited to the amount the customer paid for the relevant order.
- Livepuro is not liable for indirect damages, consequential damages, loss of profit, or missed savings.
- Nothing in these terms limits Livepuro's liability in cases where this is not permitted under mandatory law (such as intent or gross negligence).
Article 13 – Force majeure
Livepuro is not obliged to fulfil any obligation towards the customer if it is prevented from doing so as a result of force majeure, including but not limited to disruptions at suppliers, transport issues, and government measures.
Article 14 – Applicable law and disputes
- Contracts between Livepuro and the customer to which these terms and conditions relate are governed by Dutch law, unless mandatory consumer protection law of the customer's country of residence provides otherwise (this may apply, among others, to customers in the US, UK, or Belarus).
- Disputes between the parties will, as much as possible, be resolved through mutual consultation. Consumers within the EU may also use the European ODR platform (ec.europa.eu/consumers/odr) to resolve disputes.
- Unless mandatory law provides otherwise, disputes will be submitted to the competent court in the Netherlands.
